Rules Violations

Clinical laboratory personnel are extremely important in patient care. Physicians and patients must trust that all reports and test results provided by clinical laboratory personnel were obtained by competent, licensed individuals who are free from bias.

The Board of Clinical Laboratory Personnel has strict rules regarding clinical laboratory personnel. A violation of these rules can result in fines, suspension, or even criminal and civil legal penalties. The primary purpose of this course is to make sure you are aware of the types of violations that may be considered for disciplinary action. Please pay careful attention to the next several pages, which cover these violations. You are also strongly encouraged to carefully read Chapter 64B3-12 in the Florida Administrative Code, Rules of the Florida Clinical Laboratory Personnel Board, which specifically addresses Discipline.

All complaints are investigated by the Department of Health and referred to a subcommittee of the Board called the Probable Cause panel. This panel consists of two Board members who review the reports of the investigation and decide if it is likely that a violation has occurred. The case is then referred to the Board for determination of guilt and punishment.

Ignorance of the laws and rules is not an acceptable defense should you be accused of any wrong doing.
